Criminal Record Laws in Bend

Criminal history records in Oregon are treated as confidential. Under ORS 181A.220, compiled records at the state level are exempt from public inspection. Access is allowed only through court order, specific statute, or the person's own request to view their file.

When a non-law enforcement party requests someone's criminal history, the OSP follows a set process under ORS 181A.245. The subject gets written notice at their last known address. The notice includes who made the request and a copy of all data to be released. The person then has 14 days to challenge any errors before the record goes out.

If the OSP holds no criminal offender data or only nonconviction data, they respond that the person has no record. No further details are shared. The OSP keeps a log of all inquiries and the names asked about. That log is itself a public record.
